On 22 June 2010 in the case of Boroanc? v. Romania the ECHR found a violation of Article 3. In the case the authorities had failed to conduct an effective investigation into the man’s complaint that he was raped in Craiova Prison hospital by another prisoner while sedated in September 2003.
