Italy ratified the OPCAT in April 2013. In February 2014, Italy established by law a new specialised institution as the NPM, the National Authority (Garante nazionale) for the rights of persons detained or deprived of personal liberty, which coordinates the Local Authorities for the rights of persons deprived of liberty at regional and city levels.

In March 2015, a specific regulation drafted by the Ministry of Justice to implement the law was published in the Official Gazette. The selection process of the three members of the National Authority for the rights of persons deprived of liberty was finalised in March 2016. The NPM started to be operational in March-April 2016.

The SPT carried out a visit to Italy from 16 to 22 September 2015. The visit report has been made public.

NPM Structure

Italy established a new specialised institution as the NPM, the National Authority (Garantenazionale) for the rights of persons detained or deprived of personal liberty, which coordinates the Local Authorities for the rights of persons deprived of liberty at regional and city levels.

The NPM office comprises 7 units: general secretariat; IT; deprivation of liberty in the criminal justice system; deprivation of liberty by the police; deprivation of liberty and migrants; national and international relations; and support to the collegial body.

The NPM drafts its internal regulations, which are available on the NPM website.

The National Authority (NPM) is responsible for coordinating the Local Authorities and for submitting recommendations to the central Goverment, while the Local Authorities will submit recommendations to local governmental authorities.
