Benin was one of the first states in Africa to ratify the OPCAT, in September 2006. Since then, discussions have been ongoing on the establishment of the NPM.
In 2012, the Parliament adopted a new Criminal Procedure Code providing (article 808 paragraph 2) for visits to places of deprivation of liberty by external bodies, which will be the principle for the establishment of the future NPM. In 2014, during a meeting on NPM in Francophone Africa organised by the SPT and the OIF, the Benin Government representative declared that there was a consensus to create the NPM by means of Presidential Decree implementing the provision of the Criminal Procedure Code. However, the decree is still pending.
The Subcommittee on Prevention of Torture visited Benin in 2007 and Benin is the first State Party in Africa that authorised the publication of both the SPT in-country visit report as well as the governmental responses to the SPT recommendations.
The SPT member Radhia Nasraoui is the SPT Focal Point for Benin.
