Azerbaijan ratified the OPCAT in January 2009 and the same month, it designated its Ombuds Institution (Commissioner for Human Rights) as NPM by means of presidential decree. Amendments to the legislation of the Ombuds Institution were later adopted in December 2010 to provide the institution with a legal basis for its NPM work.
The Azeri NPM started its operations as soon as 2009 and a specific unit was later established within the institution to conduct visits to places of detention.
Azerbaijan also declared on the occasion of the ratification that: “it is unable to guarantee the application of the provisions of the Protocol in the territories occupied by the Republic of Armenia until these territories are liberated from occupation.”
The SPT conducted a visit to Azerbaijan in September 2014. The visit was suspended due to obstructions. The SPT could resume the visit in April 2015. The report has not been made public yet.
